Terms of Service

These terms apply to this website and to creative services provided by Momo Naked Design, Brighton, United Kingdom — website design, photography, video and interior design. They are governed by the laws of England and Wales.

Each project is also subject to the specific quote, proposal or written agreement made with the client. Where that agreement says something different from these terms, the agreement takes precedence.

“Websites from £299” is a starting price, not a fixed or all-inclusive price. The final price for any project depends on the individual requirements — scope, number of pages, features, content, photography or video needs, timescales and complexity.

A price is always quoted and agreed with the client in writing before any work begins. Quotes are based on the information provided at the time; if the requirements change, the price may be revised and re-agreed before the additional work starts.

Payment terms — including any deposit, instalments, invoicing schedule and accepted payment methods — are agreed in writing with each client before work begins and are set out in the quote or project agreement. No payment terms are implied by this website.

The scope of each project is defined in the agreed quote or proposal. Work outside that scope is treated as a new request and is quoted separately before it is carried out.

The number of revision rounds included is stated in the project quote. Additional revisions, or changes of direction after a stage has been approved, may be chargeable and will be agreed with you first.

Timelines are estimates agreed at the start of a project and depend on receiving content, feedback and approvals from the client in good time. Delays in supplying materials or feedback will move the delivery dates accordingly. We will always tell you as early as possible if a date is at risk.

Either party may end a project by giving written notice. The consequences of cancellation — including what is payable for work already completed and whether any deposit is refundable — are set out in the individual project agreement, agreed before work begins.

Consumers in the UK may also have statutory cancellation rights for contracts agreed at a distance; these are not affected by these terms.

Clients are responsible for the text, images, logos, video, product information and any other materials they supply, and confirm that they own them or have permission to use them. Momo Naked Design is not responsible for third-party claims arising from materials supplied by the client, and may decline to use material that appears unlawful or infringing.

On full payment, the client owns the final deliverables created specifically for their project. Working files, source material, concepts not selected, and any pre-existing tools, frameworks or templates used to build the work remain the property of Momo Naked Design or their respective owners, and are licensed to the client for use within the delivered work.

Unless the client asks otherwise in writing, Momo Naked Design may show completed work as part of its own portfolio and promotion.

Projects may rely on third-party services such as hosting, domain registration, content management, fonts, stock media or payment providers. Those services are governed by their own terms and their own fees, which are the client’s responsibility unless agreed otherwise. We are not responsible for outages, changes or price increases by third-party providers.

Services are provided with reasonable skill and care. To the extent permitted by law, Momo Naked Design is not liable for indirect or consequential losses, loss of profit, loss of business or loss of data, and total liability for any project is limited to the fees paid for that project.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
